PRIVACY POLICY

Human Performance Centre (HPC) acknowledges the importance you attach to information that identifies you (personal identifiers such as name, address, date of birth, email address). We are committed to protecting and managing the information you choose to share with our organisation. Through providing this information, we seek to ensure that you will be able to deal with our organisation in full confidence that your personal information will only be used by us in the ways we have described to you, that it will be held securely, and when there is no longer any legitimate purpose in retaining such information it will be disposed of appropriately. By enrolling in our courses you authorise receiving our newsletter or marketing and/or promotional material.

I acknowledge that you will disclose to me intellectual property which is confidential and proprietary information of Human Performance Centre. I will not communicate or divulge to any person any information or knowledge concerning that intellectual property or material or equipment used by Human Performance Centre or any of the intellectual property, trade secrets or proprietary information of Human Performance Centre. I will not disclose, copy, duplicate, record or reproduce, or make available to any unauthorised person or source (or permit or cause others to do so) the contents of any of the intellectual property provided by Human Performance Centre. I will not compete directly or indirectly with Human Performance Centre and its business. I acknowledge that if I fail to abide by the terms of this Agreement then Human Performance Centre will have the right to seek a court injunction to restrain that breach or claim damages against me and costs of such legal action shall be fully recoverable from me.

I consent to Human Performance Centre using the information I provide and they subsequently gather, for the purpose it was collected, to assist in the administration of products and services and to carry out all necessary activities associated with their operational business activities, workplace compliance and legal governance issues.

DIRECT DEBIT TERMS AND CONDITIONS

An initial deposit of $100 (non-refundable) to be paid upfront during enrolment. An additional $200 deposit (non-refundable) to be made 7 days prior to course commencement.

Once you have completed this online enrolment form you will be required to come into the centre and finalise your PaySmart paperwork.

You agree to continuously pay the prescribed weekly amount until the total amount of the debt is paid in full.

There are additional fees associated with the direct debit option which are additional to the total course fee. These additional costs will change depending upon the duration of your direct debit contract. Whether you pay your term out early or choose to utilise the 12, 26 or 52 week options, the total cost of the fees associated with these options will remain due and payable.

You may increase your direct debit payments at any time but the original administration fees will still apply as per your paysmart agreement. Students may not reduce to below the minimum weekly amount.

Lump sum payments can be made at any stage during the term and the overall debt can be reduced accordingly. If course fees are paid out early standard administration fees still stand as per original agreement.

Please note a $100 fee will apply for every three (3) written overdue payment reminders sent by HPC, and after three (3) defaults your file will be immediately forwarded to our debt collection department for recovery of the debt, which will incur further fees and may result in potentially diminishing your ability to borrow from a future lender. Upon three (3) defaults all assessment material (copyright to HPC) must be immediately returned to HPC. If you are currently attending a course, all overdue course fees must be paid for you to continue attending class. In the event that your file is forwarded to a debt collection agency, a reasonable administration fee will be added to the total debt owed to HPC.

If you experience financial hardship during the term, please contact us to make alternative arrangements suitable to both parties.

Dishonour fees will apply to late payments.

REFUND POLICY

All short courses are non-refundable.

If a student withdraws from the original enrolled course before it has commenced, any deposits made will not be refunded.

If a student withdraws from their original enrolled course before the first three (3) scheduled classes have been facilitated, HPC will retain all deposits made as detailed above and determine a pro rata costing structure as to ascertain a fair and reasonable cost for trainer delivery and course materials up until that date. Once the first three (3) classes of the students’ original enrolled course has been facilitated no refunds will be granted regardless of their attendance frequency. If a paysmart plan is in place, all outstanding fees remain payable in full.

If Human Performance Centre decides to postpone or cancel a course, all monies will be refunded in full. An additional $10 fee will be incurred for purchase of boxing wraps during the facilitation of the course, if you do not currently own a pair. This is not refundable.

COURSE FEES

Please note the following:

  • i All course fees must be paid in full before the certification can be granted; 
  • ii In order to utilise the Direct Debit system, please note that the additional charges associated with it are additional to your course fees. 
  • iii If you choose to defer more than two (2) times from your original enrolled course administration fees apply.
  • iv An additional $10 fee will be incurred for purchase of boxing wraps during the facilitation of the course, if you do not currently own a pair.

Please talk to any of our staff if you need any further clarification on the use of the Direct Debit system. HPC reserves the right to amend these terms and conditions at any time.

STUDENT INDEMNITY & RELEASE

I hereby give my consent to Human Performance Centre (HPC) for the videoing, photographing of myself and to the recording of my voice. HPC is hereby authorised to indefinitely use or cause to be used the still photographs or video footage, recordings of my voice and my name for advertising, publicity, commercial or other business purposes. The photographs and/or recordings may be used singularly or in conjunction with other photographs and/or recordings. I hereby release HPC, any of its associated or affiliated companies, their directors, officers agents, employees, customers and the Company’s appointed advertising agencies, officers, agents and employees, from all claims of any kind on account of such use.

If you do not wish to agree to this release please notify a staff member at time of enrolment.

You may opt out at any time, by notifying Human Performance Centre (HPC) in writing. 

INDEMNITY WAIVER

I, the undersigned, in receiving physical training by representatives of Human Performance Centre, understand and agree to comply with all of the following instructions and stipulations:

  1. I will comply with the directions of the instructors at all times 
  2. I will ask the instructors to clarify any instructions or directions I don’t fully understand 
  3. I will not engage in physical contact with any person unless instructed to by an instructor.
  4.  I will not engage in contact beyond the instructions given by the instructors. 
  5. I will not undertake any contact which is likely to injure myself or others. 
  6. I will inform the instructors of any pre-existing injuries relevant to such physical training before the commencement of any physical training. 
  7. I will immediately inform the instructors if any injury or suspected injury is sustained and the manner in which it was sustained. 
  8.  I understand that any physical training is provided only for the use within lawful situations and it is rightly intended.

I acknowledge that this is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of property claims or third parties. I assume, on behalf of myself, my heirs, personal representatives and successors, all risks of physical training, whether practicing, applying, using or not. I waive, release and discharge, on behalf of myself my heirs, personal representatives and successors, any and all claims of damages for death, personal injury or property damage which I have, or may have in the future, as a result of my practicing, applying, using or trying to use techniques shown during physical training.

I agree, on behalf of myself, my heirs, personal representatives and successors, to indemnify and hold harmless Human Performance Centre and any representatives of Human Performance Centre against all claims, losses, damages and expenses, whether asserted by me or any other person, resulting form any breach of repudiation of this agreement and release of liability, or any loss or injury to person or property, arising from or associated with the application, use or attempt at techniques shown during physical training.

TERMS AND CONDITIONS FOR THE USE OF PAYSMART

  1. You agree to continuously pay the prescribed weekly amount until the total amount of the debt is paid in full. 
  2. Whether you pay your term out early or you choose to utilise the 12, 26 or 52 week option, the total cost of the fees associated with those options will remain due and payable. 
  3. All fees must be paid in full before any certification can be granted. 
  4. If you default on your weekly payments for any reason you are not entitled to attend any further classes until that payment is promptly made.
  5. If you default 3 times or more on your weekly payments, your file will be immediately handed to our Debt Collection Department for recovery and you will be liable for any administration fees associated with such debt collection. You will also be required to return all copyrighted assessment material to Human Performance Centre immediately as it remains the property of Human Performance Centre. 
  6. If you default 3 times or more on your weekly payments and you wish to continue to complete the course, you must pay out the balance of your total debt in full before you recommence the course unless an arrangement has been entered into with HPC Management. 
  7. If you experience financial hardship during the term, please contact us to make alternative arrangements suitable to both parties. 
  8. Please note there is a one off $5.50 set up fee for using PaySmart and a weekly fee of $1.30. 
  9. If using a Credit Card, surcharges apply:
    Visa/Mastercard 1.6%
    Amex/Diners 3.5% 
  10. A $100 administration fee will apply and automatically be added to your contract for every 3 written overdue payment reminders sent to you by Human Performance Centre. 
  11. Human Performance Centre has full authority to access your credit reference history.
